Criminal aspects of international parental abduction

The Czech Police may be contacted regarding the abduction.

If a child is abducted by his or her own parent, this does not usually fall under the offense of abduction under Czech law. However, the practice of the Police of the Czech Republic may vary depending on the circumstances of the case. In some cases, police assistance can be used to trace the child's current whereabouts.

Foreign jurisdictions may treat parental abduction differently - often, it is a criminal offense. The abandoned parent can file a criminal complaint, and then the law enforcement authorities take over the role, who must investigate and possibly punish the crime.

Therefore, when moving interstate with a child, the Office of International Children's Services urges parents to secure consent to move early or to secure replacement consent from the appropriate court.
